Legal risks are like traffic accidents: we can reduce them with
clear rules and good enforcement, but law alone can't prevent them
all. Many other factors also play a role -- the cars, the drivers,
the roadway, even the weather. And so it is with legal risks. Excellent
contracting is important, but it is almost never enough. Can we identify
these other factors in the businesses we represent; and when we do,
how can we integrate "lawyering" with other approaches in
order to achieve all that Proactive Law can offer?

In many instances, 'the law' is blamed for the complexity facing
today’s businesses. In the 21st century company, 'the law' has
become a major inhibitor to business performance and competitiveness.
The legal team at most corporations is under pressure. There is a
need for greater flexibility while maintaining a responsible attitude
to risk. The relationship between the lawyers and staff in Sales,
Procurement and other commercial disciplines is changing. The new
organization must align around business processes and create ‘centres
of excellence’. |
